The city clerk is the local official for elections, local legislation, the Public Records Act, the Political Reform Act, and the Brown Act (open meeting laws). Before and after the city council takes action, the city clerk ensures that actions are in compliance with all federal, state and local statutes and regulations and that all actions are properly executed, recorded, and archived.

The statutes of the State of California prescribe the basic functions and duties of the city clerk, and the Government Code and Election Code provide precise and specific responsibilities and procedures to follow.

The office of the city clerk is a service department within the municipal government upon which the city council, all City departments, and the general public rely for information regarding the operations and legislative history of the City. The city clerk serves as the liaison between the public and city council and provides related municipal services.


As an Elections Official, the City Clerk administers Federal, State and Local procedures through which local government representatives are selected. The Clerk assists candidates in meeting their legal responsibilities before, during and after an election. From Election pre-planning to certification of election results and filing of final campaign disclosure documents, the City Clerk manages the process which forms the foundation of our democratic system of government.

As a Legislative Administrator, the City Clerk plays a critical role in the decision-making process of the local legislature. As the key staff for Council meetings, the Clerk prepares the legislative Agenda, verifies legal notices have been posted or published, and completes the necessary arrangements to ensure an effective meeting. The Clerk is entrusted with the responsibility of recording the decisions which constitute the building blocks of our representative government.

As a Records Manager, the City Clerk oversees yet another legislative process; the preservation and protection of the public record. By statute, the clerk is required to maintain and index the Minutes, Ordinances and Resolutions adopted by the legislative body. The City Clerk also ensures that other municipal records are readily accessible to the public. The public record under the conservatorship of the City Clerk provides fundamental integrity to the structure of our democracy.

PROGRAM:               Seven presenters will share examples, teach skills and foster a peer group focused on the implementation of ethics, good government and community/voter outreach efforts.  The program will help the City Clerk to develop implementation strategies and content for programs specific to the character and budgetary constraints of their unique community.

NEW IIMC CERTIFICATION POINT MINIMUMS & GRACE PERIOD

At the IIMC Board meeting held in Chicago last month, the Board discussed the reductions to travel and training budgets which are being sustained across the membership creating difficulty in meeting certification minimum point requirements for CMC, CMC Recertification, and MMC candidates. As a result of their discussion, the Board unanimously approved a temporary suspension for certification point minimums and grade periods as follows:

1. Temporary suspend the 4-year deadline for Recertification and 6 points per year  minimum for MMC candidates to be revisited at the 2009 mid-year Board  meeting.

 a. Upon the CMC 4-year anniversary date, CMC Recertification candidates    unable to meet the minimum 20 points shall submit an Application for    Admission with the $50 fee, and if desired, points accrued thus far toward    Recertification.

 b. Upon receiving a CMC, those wishing to pursue an MMC shall file an    Application for Admission and the $50 fee, regardless of the ability to    meet the 6-point per year minimum.

 c. Upon the CMC anniversary date, all MMC candidates shall annually    continue to submit points accrued, regardless of meeting the 6-point    minimum.

2. Reconfirm intent that college coursework alone (without Institute attendance) in a  related field taken before January 1, 2007, resulting in a degree qualifies a  member for the CMC Grace Period.  College coursework alone (without  Academy attendance) in a related field taken before January 1, 2007, used for  Advanced Education points, qualifies a member for the MMC Grace Period.

3. Request the IIMC Executive Director to proactively communicate the temporary  rules suspension and CMC and MMC Grace Period clarification with the  membership.

COMMITTEE MEMBERS NEEDED

Have you  ever thought about getting more involved in the City Clerk's Association of California (CCAC) by serving on a committee at the State or Division level, but are unsure  of  where to start.  The CCAC Board has created an interest card  especially for you. The information will be  shared with a CCAC representative who will contact you when committee openings become available.  This is a great way to meet other Clerks and earn points towards MMC Certification. All active CCAC Members may serve on committees. Many committee assignments  are  handled via conference call.

CMC/MMC/RECERTIFICATION GUIDELINES

In May 2008, the IIMC Board of Directors revised Education Guidelines for Certified Municipal Clerk, Master Municipal Clerk, and for Recertification.

CMC/MMC GRACE PERIODS

At the May 2008 Annual Meeting in Atlanta, the IIMC Board of Directors spent the first portion of their meeting discussing IIMC’s education philosophy. Given the on-going concerns with the education program guidelines, the Board unanimously voted to implement the following items:

 

Extend the “grace period” to complete CMC and MMC certification programs through 2009; and
Reduce the MMC annual point candidacy requirements from 12 to 6; and
Eliminate the bachelor degree requirement for MMC certification.

 

Education discussions will be on-going and will include a membership survey in upcoming months.

 

A detailed explanation and flow charts of what that means to each of you individually has been summarized in two helpful documents, which can be found below. We are already hearing from Clerks who have benefited from the grace period and are forwarding now completed applications to IIMC much earlier than anticipated! Take the time to read through these materials. The accommodations offered are significant.
